DV AOS Step by Step – Part 1

Please read ALL entries in this Guide (except the one indicated) and do not underestimate the DV AOS procedure.

Visa Lottery Winners opting for AOS need first complete and submit Form DS-260.
On this form you must indicate that you opt for Adjustment of Status.

If your situation changes after you submitted the Visa Application you can contact the KCC and ask to ‘unlock’ your Form DS-260 so you can change and/or add information.
You can also use ‘unlock’ if you realize after submitting the form that you gave an incorrect or incomplete answer.

The next step is paying the DV Surcharge to the Department of State. Payment must be received by DOS before you can submit your I-485 Application with USCIS.
Do not forget to include the SASE when you mail in your payment and letter.
You will be sent a receipt as proof for the surcharge payment.

You can then start to complete the required forms, collect the documentation, have photos made, etc.
You must also make an appointment for the mandatory Medical Examination.

The AOS ‘package(s)’

All forms required for the I-485 AOS Application must be submitted on paper.

The AOS Application ‘package’ for the Primary Applicant must contain:
Completed and signed form I-485, other forms as needed, payment, photos, copies of documents to be submitted during the interview, the results of the medical exam, other documentation depending on the individual situation of applicant, cover letter.

The AOS Application ‘package for a Derivative Applicant must contain:
Completed and signed forms (I-485, I-134), other forms as needed, payment, photos, copies of documents to be submitted during the interview, the results of the medical exam, other documentation, cover letter.

Holders of an A, E or G Visa must also include Form I-508 Waiver of Rights, Privileges, Exemptions, Immunities.

Copy the contents of each ‘package’ including the payment for your own file.

Visa Bulletin

Check the Visa Bulletin on the website of the State Department regularly. When your Case Number is lower than the expected Cut-Off Number for the upcoming month, you can mail your AOS ‘package(s)’ to USCIS.
